By accessing or using TapNFC ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.
2. Description of Service
TapNFC is a web-based platform that provides tools for creating interactive digital experiences, business cards, portfolios, and landing pages. The Service includes a drag-and-drop editor, multimedia support, animation features, and project export capabilities.
3. User Accounts
3.1 Account Creation: You must create an account to use certain features. You agree to provide accurate and complete information.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials.
3.3 Age Requirement: You must be at least 13 years old to use our Service.
3.4 Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans & Billing
4.1 Plans: We offer FREE, BASIC, PRO, and BUSINESS subscription plans with different features and limitations.
4.2 Payment: Paid subscriptions are billed monthly or annually through Stripe. All fees are non-refundable unless required by law.
4.3 Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date.
4.4 Cancellation: You may cancel your subscription at any time through your account settings. Access continues until the end of the billing period.
4.5 Price Changes: We may change subscription prices with 30 days' notice. Changes apply to subsequent billing cycles.
5. User Content & Intellectual Property
5.1 Your Content: You retain all rights to content you create or upload. You grant us a license to host, store, and display your content as necessary to provide the Service.
5.2 Content Responsibility: You are solely responsible for your content and must ensure it complies with all applicable laws.
5.3 Our Rights: All Service features, designs, and intellectual property are owned by TapNFC and protected by copyright and trademark laws.
5.4 Exported Projects: Content you export is yours to use as you see fit, subject to any third-party licenses (e.g., fonts, stock media).
6. Prohibited Activities
You agree NOT to:
- Violate any laws or regulations
- Infringe on others' intellectual property rights
- Upload malicious code, viruses, or harmful content
- Attempt to hack, compromise, or disrupt the Service
- Create fake accounts or impersonate others
- Scrape or harvest data from the Service
- Use the Service for spam or unauthorized marketing
- Share your account with others
- Resell or redistribute the Service without permission
- Upload illegal, offensive, or harmful content
7. Export Limits & Usage
Each subscription plan has monthly export limits. Exceeding your limit requires upgrading your plan. We reserve the right to enforce these limits and may temporarily restrict access if abuse is detected.
8. Third-Party Services
Our Service integrates with third-party services (Google, Facebook, Stripe, Supabase). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or content.
9. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.
10. Data & Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.
11. Disclaimers & Limitations of Liability
11.1 "AS IS" Service: The Service is provided "as is" without warranties of any kind, express or implied.
11.2 No Guarantees: We do not guarantee that the Service will meet your requirements or be error-free.
11.3 Limitation: To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages.
11.4 Maximum Liability: Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless TapNFC from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time through account settings.
14. Dispute Resolution
14.1 Governing Law: These Terms are governed by the laws of Greece, without regard to conflict of law provisions.
14.2 Arbitration: Any disputes shall be resolved through binding arbitration, except where prohibited by law.
14.3 Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions.

We may modify these Terms at any time. Material changes will be notified via email or a notice on the Service. Your continued use after changes constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
